Terms of Service

These Terms of Service govern access to and use of FosterHub, a software-as-a-service platform for animal rescue organizations, foster-based shelters, admins, staff, volunteers, and foster caregivers. By creating an account, using the service, starting a subscription, or accessing an organization workspace, you agree to these Terms.
Plain-English note: FosterHub helps rescue teams coordinate work. Your organization remains responsible for animal care decisions, users, legal compliance, and the content entered into its workspace.
1. Service Overview
FosterHub provides web-based tools for animal and foster profile management, foster updates, admin dashboards, foster chat and requests, calendar coordination, resources and FAQs, emergency alerts, email notifications, SMS notifications, uploaded animal photos/documents, role-based accounts, organization settings, and subscription billing.
FosterHub is software only. FosterHub does not provide veterinary, legal, animal behavior, adoption, placement, transportation, emergency response, professional rescue, or animal welfare services. Organizations and users make their own care, screening, placement, adoption, medical, safety, and operational decisions.
2. Eligibility and Authority
You must be at least 18 years old to create or administer a FosterHub account. If you use FosterHub on behalf of an animal rescue organization, shelter, nonprofit, business, or other entity, you represent that you are authorized to accept these Terms for that organization and to manage the organization workspace.
3. Accounts and Security
Users are responsible for keeping login credentials secure and for activity under their accounts. Organizations are responsible for approving users, managing admin access, assigning roles, removing users who no longer need access, and reviewing workspace activity. You may not share accounts in a way that bypasses role-based access, impersonate another person, or access an organization workspace without authorization.
4. Subscription Billing
Paid FosterHub plans are billed as recurring subscriptions through Stripe. By starting a paid plan, the organization authorizes recurring charges for the selected plan and any applicable add-ons, taxes, or fees until the subscription is canceled or otherwise ends.
- Automatic renewal: subscriptions renew automatically at the applicable billing interval unless canceled before renewal.
- Stripe processing: payment details are processed by Stripe. FosterHub does not store raw credit card numbers.
- Cancellation: cancellation generally stops future renewals. Access may continue until the end of the paid billing period unless the account is suspended or the plan terms state otherwise.
- Downgrades: downgrades may reduce future feature access, plan limits, admin seat availability, SMS availability, or program capacity. Existing content is not automatically deleted solely because of a downgrade, but new activity may be blocked when plan limits are exceeded.
- Failed payments: failed, disputed, or overdue payments may lead to retries, past-due status, feature limits, suspension, or cancellation.
- Refunds: Except where required by law or expressly agreed by FosterHub in writing, payments are non-refundable.
- Plan gating: FosterHub may limit features, admin seats, emergency alerts, SMS, resources, FAQs, calendar items, analytics, or other functionality by plan.
- Pricing changes: FosterHub may modify plan pricing, features, or billing terms with reasonable notice where required. Continued use after changes take effect means the updated pricing or terms apply.
5. Acceptable Use
You agree not to misuse FosterHub or use it in a way that harms users, animals, organizations, FosterHub, or third-party systems. Prohibited activity includes:
- Illegal activity, fraud, harassment, threats, discrimination, abuse, or invasive conduct.
- Spam, unsolicited marketing, deceptive messages, or abusive SMS/email use.
- Attempting to access accounts, data, systems, organizations, or features without authorization.
- Uploading malware, harmful code, or content designed to disrupt, overload, or compromise systems.
- Scraping, bulk exporting, automated harvesting, or excessive API/browser activity that harms service reliability or violates privacy.
- Reverse engineering, copying, reselling, sublicensing, or exploiting FosterHub except as permitted by law.
- Entering content that violates privacy rights, intellectual property rights, animal welfare laws, or other applicable obligations.
6. User Content and Organization Data
Organizations and users retain ownership of the animal records, photos, documents, foster data, messages, updates, resources, FAQs, calendar entries, and other content they submit to FosterHub. By submitting content, you grant FosterHub a limited, worldwide, non-exclusive license to host, store, process, transmit, display, back up, secure, and use that content as needed to provide, support, maintain, and improve the service.
Organizations are responsible for ensuring they have the rights and permissions needed to upload and process content, including personal information, animal photos, medical notes, foster details, and organization records. FosterHub may remove content or restrict access if we believe it violates these Terms, law, security requirements, or third-party rights.
Organizations are responsible for how exported, downloaded, printed, copied, screenshotted, emailed, or externally shared data is handled outside of FosterHub. FosterHub is not responsible for data handling after information leaves the platform through an authorized user action.
7. SMS Terms
FosterHub may provide operational SMS notifications through Twilio, including emergency foster alerts, rescue coordination messages, scheduling updates, and account or workflow notices. SMS is transactional and operational, not unsolicited marketing.
- Users must opt in before receiving FosterHub SMS notifications.
- Organizations are responsible for using SMS features only for lawful, consent-based operational purposes.
- Message frequency may vary depending on rescue activity, emergency alerts, and user preferences.
- Message and data rates may apply.
- Reply STOP to opt out where supported. Reply HELP for help where supported, or contact support@getfosterhub.com.
- FosterHub may disable SMS access if it detects abuse, carrier compliance risk, unsupported use, or plan/payment restrictions.
8. Platform Availability and Changes
FosterHub is provided on an "as is" and "as available" basis. We work to keep the service reliable, but we do not guarantee uninterrupted access, error-free operation, SMS/email delivery, emergency alert delivery, data transmission timing, or any particular uptime level. Maintenance, outages, third-party provider issues, internet failures, carrier filtering, browser changes, or security events may affect availability.
Features may evolve, change, be added, or be removed over time. We may modify workflows, plan limits, UI, integrations, billing behavior, notification methods, or technical infrastructure as the product develops.
FosterHub is not responsible for delays, interruptions, or failures caused by events outside its reasonable control, including natural disasters, internet outages, power failures, labor disputes, cyberattacks, government actions, carrier disruptions, third-party provider outages, payment processor outages, hosting provider outages, or other force majeure events.
9. Intellectual Property
FosterHub, including its software, interface, workflows, design, branding, logos, text, graphics, code, and related materials, is owned by FosterHub or its licensors and is protected by intellectual property laws. These Terms do not grant ownership of FosterHub software or branding. You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from FosterHub except as expressly allowed by FosterHub in writing.
10. Animal Care and Operational Disclaimer
Animals can be unpredictable, and rescue operations involve risk. FosterHub is not responsible for animal behavior, animal health, bites, scratches, injuries, disease transmission, property damage, escape, loss, death, veterinary outcomes, foster/adopter conduct, volunteer availability, screening decisions, placement decisions, adoption decisions, transportation, emergency response, or compliance with animal welfare laws. Organizations and users remain responsible for evaluating animals, people, homes, risks, and emergency situations outside of FosterHub.
11. Third-Party Services
FosterHub uses third-party providers including Firebase and Google Cloud for authentication, hosting, database, storage, and infrastructure; Stripe for subscription billing; Twilio for SMS; and email or monitoring providers for operations. Third-party services may have their own terms, privacy notices, limits, outages, compliance requirements, and fees. FosterHub is not responsible for third-party service failures outside our control.
Third-party integrations, APIs, imports, exports, or connected systems may rely on external platforms that FosterHub does not control. Those services may change, fail, become unavailable, limit access, alter APIs, or experience outages. FosterHub is not responsible for failures or changes in third-party integrations outside its control.
12. Termination and Suspension
Organizations may cancel subscriptions or deactivate users through available account controls or by contacting support. FosterHub may suspend or terminate accounts, organizations, SMS access, billing access, or specific features if we believe there is a Terms violation, payment failure, security risk, legal risk, abusive conduct, SMS compliance risk, or harm to users, animals, organizations, FosterHub, or third parties.
13. Disclaimers
To the fullest extent permitted by law, FosterHub disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and reliability. FosterHub does not warrant any foster placement, adoption, animal care, emergency, communication, billing, SMS, email, or operational outcome.
14. Limitation of Liability
To the fullest extent permitted by law, FosterHub will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost goodwill, lost data, rescue outcomes, animal-related incidents, user conduct, third-party provider failures, SMS/email delivery failures, emergency alert failures, service interruptions, or decisions made through or because of the platform.
FosterHub's total liability for all claims arising from or relating to the service or these Terms will not exceed the amount paid to FosterHub by the organization for the service during the twelve months before the event giving rise to the claim, or one hundred dollars if no amount was paid, except where a different limit is required by law.
15. Indemnification
To the extent permitted by law, organizations and users agree to defend, indemnify, and hold FosterHub harmless from claims, losses, liabilities, damages, costs, and expenses arising from their content, misuse of the service, violation of these Terms, violation of law, animal-related operations, SMS misuse, or infringement of third-party rights.
16. Governing Law
These Terms are governed by the laws of Ohio, United States, without regard to conflict-of-law principles. Any disputes will be handled in state or federal courts located in Ohio unless applicable law requires a different venue.
17. Changes to These Terms
We may update these Terms as FosterHub evolves. If we make material changes, we will update the effective date and may provide additional notice through the service or by email where appropriate. Continued use of FosterHub after updated Terms become effective means you accept the updated Terms.
18. Copyright and Intellectual Property Complaints
If you believe content uploaded to FosterHub infringes your copyright, trademark, or other intellectual property rights, contact support@getfosterhub.com with enough information to identify the material, the claimed rights, and your contact information. FosterHub may remove or restrict access to allegedly infringing content while reviewing the report.
